1. Acceptance of Terms

By accessing and using clevrkids ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

clevrkids provides online cognitive assessment tools designed for children aged 4 to 16. Our Service includes IQ testing, cognitive profiling, and educational assessment reports. The Service is intended for educational and informational purposes only.

3. Use of Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission
  • Use automated systems to access the Service in a manner that sends more request messages than a human can reasonably produce

4. Age Restrictions and Parental Consent

Our Service is designed for children aged 4 to 16. By using the Service for a child, you represent and warrant that you are the parent or legal guardian of the child, or have obtained proper authorization from the parent or legal guardian. You are responsible for ensuring that the child's use of the Service complies with these Terms.

5. Assessment Results and Limitations

The results provided by our Service are estimates based on standardized testing methodologies. These results are not a substitute for professional psychological evaluation, clinical diagnosis, or medical advice. clevrkids assessments are screening tools and should not be used as the sole basis for educational placement, medical diagnosis, or treatment decisions.

We do not guarantee the accuracy, completeness, or reliability of any assessment results. Results may vary based on factors including but not limited to the child's condition, environment, and participation level.

6. Pricing and Payment

Standard assessments may be offered free for qualified users at our discretion. School and bulk pricing is available upon request. All prices are subject to change without notice. Payment terms will be specified at the time of purchase or agreement.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by clevrkids and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not modify, reproduce, distribute, create derivative works, publicly display, or otherwise use any content from the Service without our prior written permission.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

clevrkids does not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not warrant that the results obtained from use of the Service will be accurate or reliable.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, clevrkids SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to defend, indemnify, and hold harmless clevrkids and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
